1. INTRODUCTION

These Company Terms of Service ("Terms", "Terms of Service", or "Agreement") constitute a legally binding agreement between Web Boomers ("Web Boomers", "we", "us", or "our") and the individual, business, organization, or other legal entity accessing, purchasing, or using our website, products, hosting services, software-related services, development services, design services, marketing services, or any other service offered by Web Boomers ("Customer", "Client", "you", or "your").

By creating an account, submitting an order, accepting a quotation, making a payment, checking an acceptance box, accessing a service, or otherwise using a Web Boomers service, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you should not purchase or use our services.

These Terms should be read together with any applicable:

  • Privacy Policy;
  • Refund Policy;
  • Cancellation Policy;
  • Acceptable Use Policy;
  • Disclaimer;
  • Copyright Notice;
  • individual quotation or proposal;
  • hosting plan specifications;
  • order form;
  • invoice;
  • service-specific agreement; and
  • other policies published by Web Boomers.

Where a service-specific written agreement expressly conflicts with these Terms, the service-specific agreement will control to the extent of that conflict.

2. ABOUT WEB BOOMERS

Web Boomers is a proprietorship operating from Singur, West Bengal, India.

We provide digital and technology services including, but not limited to:

  • Website Development
  • Custom Website Development
  • Business Websites
  • Portfolio Websites
  • E-commerce Websites
  • Landing Pages
  • Web Applications
  • Website Redesign
  • Website Maintenance
  • Website Migration
  • Web Hosting
  • Domain Registration
  • SSL-related Services
  • Business Email
  • Search Engine Optimization (SEO)
  • Digital Marketing
  • Online Advertising
  • Graphic Design
  • UI/UX Design
  • Website Management
  • Technical Support
  • Other related digital services

The exact services available to a Customer depend on the products and plans offered by Web Boomers at the time of purchase.

3. DEFINITIONS

For the purpose of these Terms:

"Account" means the customer account created to access Web Boomers' client area, billing system, hosting services, or other services.

"Billing Account" means the account used to manage invoices, payments, subscriptions, orders, and services.

"Service" means any product or service provided by Web Boomers.

"Hosting Service" means any web hosting, server, storage, email hosting, or related infrastructure service provided by or through Web Boomers.

"Project" means a custom development, design, marketing, or other professional service engagement.

"Third-Party Provider" means an external company or service provider used in connection with a Web Boomers service.

"Content" means text, images, videos, audio, documents, software, databases, code, trademarks, logos, data, or other material.

"Customer Content" means content supplied, uploaded, transmitted, or otherwise provided by the Customer.

"Due Date" means the payment date shown on an invoice or otherwise communicated by Web Boomers.

4. ACCEPTANCE OF TERMS

By using our website or services, you confirm that:

  1. the information you provide is accurate and complete;
  2. you have authority to enter into this Agreement;
  3. you will use our services lawfully;
  4. you will comply with these Terms;
  5. you will comply with applicable laws and regulations;
  6. you will maintain the security of your account;
  7. you will pay all applicable charges on time; and
  8. you will not use our services to harm Web Boomers, its infrastructure, other customers, or third parties.

If you are purchasing services on behalf of a company or organization, you represent that you have authority to bind that entity.

5. ACCOUNT REGISTRATION

Certain Web Boomers services may require you to create an account.

You agree to provide accurate and current information during registration.

Information may include:

  • Full Name
  • Email Address
  • Phone Number
  • Address
  • Company Name
  • GST/VAT information where applicable
  • Business Type
  • Billing Information
  • Other information reasonably required to provide the service

You must promptly update inaccurate or outdated information.

We may require additional information where reasonably necessary for account verification, fraud prevention, billing, service activation, domain registration, hosting requirements, payment-provider requirements, or legal compliance.

6. ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of:

  • your account credentials;
  • passwords;
  • API credentials;
  • hosting credentials;
  • control-panel credentials;
  • email credentials; and
  • other authentication information.

You must not share your account credentials with unauthorized persons.

If you believe your account has been compromised, you should contact Web Boomers immediately.

Web Boomers will not be responsible for losses caused by unauthorized access resulting from the Customer's failure to protect account credentials, except to the extent liability cannot legally be excluded.

7. PASSWORD STORAGE

Where Web Boomers stores account passwords for authentication, passwords are stored using password hashing rather than readable plain-text storage.

Web Boomers does not intentionally store Customer passwords in readable plain text.

Customers should never provide their passwords to Web Boomers through insecure communication channels unless specifically required for a legitimate technical purpose and through an appropriate secure process.

8. ORDERS AND SERVICE ACTIVATION

A Customer may purchase a service through the Web Boomers website, client portal, quotation, invoice, or another approved ordering method.

An order may be subject to:

  • payment verification;
  • account verification;
  • availability;
  • technical feasibility;
  • domain availability;
  • third-party approval;
  • fraud screening;
  • identity or business verification; or
  • other reasonable checks.

Web Boomers may refuse or cancel an order where there is a legitimate reason, including suspected fraud, inaccurate information, unlawful use, technical impossibility, payment problems, or violation of these Terms.

9. PRICING

Prices displayed on the website, client portal, quotation, or invoice are subject to change.

The applicable price for an order is generally the price shown at the time the order is accepted, subject to:

  • applicable taxes;
  • renewal pricing;
  • promotional terms;
  • third-party costs;
  • domain pricing;
  • infrastructure costs;
  • currency changes;
  • service modifications; or
  • other expressly disclosed charges.

Promotional prices may be available only for a specified initial period and may not apply to renewals.

10. TAXES

Customers are responsible for applicable taxes, duties, government charges, or other legally applicable amounts unless expressly stated otherwise.

Where Web Boomers is required to charge GST or another applicable tax, the tax may be added to the applicable service price.

Customers providing GST or tax information are responsible for ensuring that such information is accurate.

11. PAYMENT TERMS

Payments must be made by the due date stated on the relevant invoice.

Web Boomers may support payment methods including:

  • UPI;
  • bank transfer;
  • Razorpay;
  • PhonePe;
  • cards or other payment methods made available through supported payment providers; and
  • other methods introduced by Web Boomers.

Payment providers may apply their own terms, security controls, transaction limits, fraud checks, or processing procedures.

A payment is considered complete only when the applicable payment has been successfully received or confirmed.

12. FAILED, PENDING, OR DUPLICATE PAYMENTS

If money is deducted from your bank account but your order is not immediately marked as paid, you should not make repeated payments without first checking the transaction status where reasonably possible.

If a transaction is pending, Web Boomers may wait for confirmation from the payment provider.

Verified duplicate payments may be eligible for refund under our Refund Policy.

Any non-recoverable payment-processing costs may be deducted where legally permitted.

13. CUSTOM WEBSITE DEVELOPMENT

Custom website development is performed according to an agreed scope.

The applicable project scope may include:

  • number of pages;
  • design requirements;
  • functionality;
  • integrations;
  • technologies;
  • content requirements;
  • delivery requirements;
  • hosting requirements;
  • revisions;
  • project timeline; and
  • other specifications.

Anything not expressly included in the approved scope may be considered additional work.

14. CUSTOM WEBSITE PAYMENT STRUCTURE

Unless otherwise agreed in writing:

50% advance payment is required before development begins.

The remaining 50% balance is payable before:

  • final delivery;
  • production deployment;
  • transfer of ownership;
  • release of source files;
  • transfer of administrative access; or
  • other final handover.

Web Boomers may agree to alternative milestone structures in writing.

15. PROJECT REVISIONS

Unless otherwise specified:

Custom Website Development

Includes:

1 free revision.

Graphic Design

Includes:

1 major revision + 3 minor revisions.

A revision means a reasonable modification to the agreed design or deliverable.

A revision does not include:

  • complete redesign;
  • change of project direction;
  • new functionality;
  • new pages;
  • additional designs;
  • replacement of previously approved concepts;
  • major content restructuring; or
  • work outside the agreed scope.

Additional work may be billed separately.

16. CLIENT CONTENT

The Customer is responsible for providing the content required for a project.

This may include:

  • text;
  • photographs;
  • logos;
  • product information;
  • business information;
  • documents;
  • pricing;
  • videos;
  • graphics;
  • legal content;
  • trademarks;
  • contact information; and
  • other materials.

The Customer represents that it has the necessary rights, permissions, and authority to provide and use such material.

Web Boomers is not responsible for infringement caused by materials supplied by the Customer.

17. CLIENT APPROVALS

The Customer should review designs, previews, staging websites, content, and other deliverables carefully.

Unless otherwise agreed, Customers should provide feedback or approval within 3 days of receiving a review request.

Delays in:

  • feedback;
  • approvals;
  • content;
  • payments;
  • credentials;
  • domain information;
  • hosting information; or
  • other required materials

may delay project completion.

18. PROJECT TIMELINES

Any project timeline provided by Web Boomers is an estimate unless expressly stated as a guaranteed contractual deadline.

Timelines may be affected by:

  • Customer delays;
  • changes in requirements;
  • additional revisions;
  • third-party services;
  • hosting issues;
  • domain issues;
  • API limitations;
  • payment delays;
  • unavailable resources;
  • technical problems; or
  • force majeure events.

19. WEBSITE DELIVERY

After full payment and completion of the agreed project, Web Boomers may provide the applicable final deliverables.

Depending on the project, these may include:

  • website files;
  • source code;
  • database;
  • design files;
  • administrative access;
  • hosting information;
  • relevant credentials; and
  • other agreed materials.

Third-party licences, subscriptions, software, themes, plugins, APIs, and other licensed materials remain subject to their respective licence terms.

20. INTELLECTUAL PROPERTY

After full payment, ownership of the final custom deliverables specifically created for the Customer will transfer according to the applicable quotation or project agreement.

However, Web Boomers retains ownership of:

  • pre-existing code;
  • reusable frameworks;
  • libraries;
  • generic components;
  • templates;
  • internal tools;
  • development systems;
  • processes;
  • methodologies;
  • technical know-how;
  • reusable design systems; and
  • other materials not created exclusively for the Customer.

Nothing in these Terms transfers third-party intellectual property.

21. HOSTING SERVICES

Web Boomers may provide shared hosting, premium hosting, server resources, storage, email hosting, databases, and related infrastructure.

Hosting features depend on the selected plan.

Each hosting plan may have different:

  • storage limits;
  • bandwidth limits;
  • CPU limits;
  • RAM limits;
  • inode limits;
  • email limits;
  • database limits;
  • backup features;
  • server features;
  • technical restrictions; and
  • renewal prices.

Customers must use hosting services in accordance with the selected plan.

22. HOSTING BILLING

Hosting services are normally billed according to the selected billing cycle.

Invoices must be paid on or before the applicable due date.

Customers are responsible for maintaining sufficient payment information and monitoring their account.

23. HOSTING GRACE PERIOD

If a hosting invoice is not paid on the due date, Web Boomers provides a 5-day grace period.

The general process is:

Invoice Due → 5-Day Grace Period → Suspension → Termination → Data Deletion

During the grace period, Web Boomers may send payment reminders.

After the grace period expires, Web Boomers may suspend the hosting service.

24. HOSTING SUSPENSION

A suspended service may become inaccessible.

Suspension may affect:

  • website access;
  • databases;
  • email;
  • FTP/SFTP;
  • control panel;
  • applications;
  • APIs; and
  • other hosting functions.

A suspended account may be restored after the applicable outstanding amount has been paid, subject to technical availability and other applicable conditions.

25. HOSTING TERMINATION

Continued non-payment after suspension may result in termination.

A terminated account may no longer be recoverable.

After termination, Web Boomers may delete associated hosting data.

Customers are responsible for maintaining their own copies of important information.

26. HOSTING BACKUPS

Standard Web Hosting does not include guaranteed backups.

Customers should maintain independent backups of:

  • websites;
  • databases;
  • email;
  • files;
  • configurations; and
  • other important information.

Premium Web Hosting includes the backup features expressly stated for that plan.

Even where backups are provided, backups should not be treated as an absolute guarantee against data loss.

Web Boomers is not responsible for data loss to the extent caused by circumstances outside our reasonable control, subject to applicable law.

27. DOMAIN NAMES

Domain registration and renewal services may be provided through third-party domain registrars.

Domain names are subject to:

  • registrar policies;
  • registry policies;
  • ICANN policies where applicable;
  • country-code registry rules where applicable;
  • domain dispute policies; and
  • applicable law.

Web Boomers does not guarantee that a requested domain name will remain available.

Customers are responsible for providing accurate registrant information.

Domain charges are generally non-refundable after registration or renewal, subject to applicable registrar rules and applicable law.

28. SSL AND SECURITY CERTIFICATES

Where SSL certificates are provided, their availability and renewal may depend on the relevant certificate provider.

Web Boomers does not guarantee that every third-party SSL certificate will remain available or compatible indefinitely.

29. ACCEPTABLE USE

Customers must not use Web Boomers services for unlawful, fraudulent, abusive, malicious, or harmful purposes.

Prohibited activities include, without limitation:

  1. phishing;
  2. malware distribution;
  3. ransomware;
  4. credential theft;
  5. unauthorized access;
  6. hacking;
  7. brute-force attacks;
  8. malicious scanning;
  9. denial-of-service attacks;
  10. spam;
  11. fraudulent websites;
  12. impersonation;
  13. copyright infringement;
  14. trademark infringement;
  15. distribution of stolen information;
  16. illegal content;
  17. scams;
  18. payment fraud;
  19. abuse of server resources;
  20. activities that damage other customers;
  21. activities that cause serious reputational or operational risk;
  22. attempts to bypass security controls; or
  23. any other activity prohibited by applicable law.

30. RESOURCE ABUSE

Customers must not intentionally or negligently consume resources in a manner that materially affects other customers or infrastructure.

Examples may include:

  • excessive CPU usage;
  • excessive memory consumption;
  • abusive database activity;
  • malicious scripts;
  • mass email activity;
  • excessive storage;
  • network abuse;
  • automated attacks; or
  • activities causing server instability.

Web Boomers may contact the Customer and request corrective action.

Where necessary to protect infrastructure or other customers, Web Boomers may temporarily restrict or suspend the affected service.

31. EMAIL AND SPAM

Web Boomers services must not be used for unlawful spam or abusive bulk messaging.

Customers are responsible for ensuring that their email practices comply with applicable law and the requirements of relevant email providers and infrastructure providers.

If an account causes serious spam complaints, blacklisting, or infrastructure damage, Web Boomers may suspend the affected service.

32. SECURITY INCIDENTS

Customers must promptly report suspected:

  • account compromise;
  • malware;
  • unauthorized access;
  • security vulnerabilities;
  • credential theft;
  • suspicious activity; or
  • other security incidents.

Web Boomers may temporarily restrict an account where reasonably necessary to prevent further damage.

33. THIRD-PARTY SERVICES

Web Boomers may use or integrate third-party services, including:

  • Razorpay;
  • PhonePe;
  • Google Analytics;
  • Google reCAPTCHA;
  • Cloudflare;
  • WhatsApp;
  • email providers;
  • domain registrars;
  • hosting infrastructure providers;
  • software providers;
  • plugins;
  • themes;
  • APIs;
  • advertising platforms; and
  • other technology providers.

Third-party services are subject to their own terms and policies.

Web Boomers is not responsible for third-party:

  • outages;
  • pricing;
  • policy changes;
  • account restrictions;
  • API changes;
  • service discontinuation;
  • security incidents;
  • transaction failures; or
  • technical limitations.

34. PAYMENT PROCESSORS

Payments may be processed using third-party payment providers such as Razorpay and PhonePe.

Customers may be redirected to a payment provider or may interact with a provider's payment interface.

Web Boomers does not intentionally store sensitive payment credentials such as card PINs or banking passwords.

Payment providers may independently process transaction information according to their policies.

35. FRAUD PREVENTION

Web Boomers may use reasonable fraud-prevention measures.

Orders or transactions may be reviewed where there is a reasonable indication of:

  • fraudulent activity;
  • identity mismatch;
  • unusual payment behaviour;
  • chargeback abuse;
  • unauthorized payment;
  • suspicious account activity; or
  • other security concerns.

Where reasonably necessary, Web Boomers may delay activation while a transaction is verified.

36. SEO AND DIGITAL MARKETING

SEO and digital marketing results depend on many factors outside Web Boomers' control.

These may include:

  • search-engine algorithms;
  • competitors;
  • market conditions;
  • advertising platforms;
  • customer behaviour;
  • website quality;
  • content;
  • budget;
  • industry;
  • search demand; and
  • third-party policy changes.

Unless expressly guaranteed in writing, Web Boomers does not guarantee:

  • a particular Google ranking;
  • specific traffic;
  • specific leads;
  • specific sales;
  • revenue;
  • conversion rates;
  • advertising return;
  • or any specific commercial result.

37. GRAPHIC DESIGN SERVICES

Graphic design services are performed according to the agreed scope.

Unless otherwise stated, graphic design includes:

1 major revision and 3 minor revisions.

Additional concepts, major redesigns, additional formats, additional sizes, or additional revisions may incur additional charges.

38. MAINTENANCE SERVICES

Website maintenance services are limited to the scope purchased.

Maintenance may include:

  • updates;
  • minor corrections;
  • content changes;
  • troubleshooting;
  • security-related maintenance;
  • backups where expressly included;
  • compatibility work; or
  • other agreed services.

Maintenance does not automatically include new functionality or complete redesign.

39. TECHNICAL SUPPORT

Support is provided through the channels designated by Web Boomers.

Support may include assistance with Web Boomers services, billing, hosting, accounts, and other purchased services.

Support does not guarantee:

  • immediate response;
  • immediate resolution;
  • third-party resolution; or
  • resolution of issues outside our control.

40. SERVICE AVAILABILITY

Web Boomers aims to provide reliable services but does not guarantee uninterrupted availability unless a specific written SLA states otherwise.

Services may become temporarily unavailable because of:

  • maintenance;
  • hardware failure;
  • software failure;
  • network problems;
  • cyber incidents;
  • DNS issues;
  • domain problems;
  • upstream provider failures;
  • power failures;
  • force majeure events; or
  • other circumstances outside reasonable control.

41. FORCE MAJEURE

Web Boomers shall not be responsible for delay or failure caused by circumstances beyond reasonable control, including:

  • natural disasters;
  • floods;
  • fire;
  • earthquakes;
  • war;
  • terrorism;
  • government action;
  • internet-wide failures;
  • major network outages;
  • power failures;
  • cyberattacks;
  • widespread infrastructure failures;
  • third-party provider failures;
  • labour disruptions; or
  • other extraordinary circumstances.

42. REFUNDS

Refunds are governed by the Web Boomers Refund Policy.

Unless specifically stated otherwise or required by applicable law:

payments are non-refundable.

Premium Web Hosting has a limited refund provision:

7 days from activation, subject to deduction of the applicable 7-day server cost.

Verified duplicate payments may be refundable.

Custom development, graphic design, SEO, marketing, domain, third-party, and other completed or commenced services are generally non-refundable.

43. CANCELLATION

Customers may request cancellation according to the Web Boomers Cancellation Policy.

Cancellation does not automatically create a refund.

For hosting services, cancellation may either:

  • stop future renewal; or
  • result in immediate termination where requested and technically possible.

Customers should download required data before termination.

44. NON-PAYMENT

If an invoice remains unpaid:

  1. the invoice becomes due;
  2. a 5-day grace period may apply;
  3. the service may be suspended;
  4. continued non-payment may result in termination; and
  5. associated data may subsequently be deleted.

The Customer remains responsible for charges incurred before termination.

45. TERMINATION BY WEB BOOMERS

Web Boomers may suspend or terminate services where reasonably necessary because of:

  • non-payment;
  • unlawful activity;
  • fraud;
  • abuse;
  • security risks;
  • material breach of these Terms;
  • excessive resource abuse;
  • unauthorized activity;
  • false information;
  • repeated violations;
  • legal requirements; or
  • circumstances making continued service impractical.

Where appropriate and reasonably possible, Web Boomers may provide notice before termination.

Immediate suspension or termination may occur where necessary to protect infrastructure, customers, security, or legal interests.

46. EFFECT OF TERMINATION

Upon termination:

  • access to services may stop;
  • websites may become unavailable;
  • hosting data may be deleted;
  • accounts may be closed;
  • subscriptions may stop;
  • third-party services may expire;
  • unpaid amounts remain due; and
  • certain information may be retained where legally or operationally necessary.

Customers are responsible for obtaining their own backups before termination.

47. DATA RETENTION

Web Boomers may retain information for as long as reasonably necessary for:

  • service delivery;
  • billing;
  • accounting;
  • taxation;
  • legal compliance;
  • fraud prevention;
  • dispute resolution;
  • security;
  • recordkeeping; and
  • legitimate business purposes.

Data may be deleted when it is no longer reasonably required, subject to applicable legal obligations.

48. PRIVACY

Personal information is handled according to the Web Boomers Privacy Policy and applicable law.

Web Boomers may process information necessary to:

  • provide services;
  • manage accounts;
  • process payments;
  • communicate with Customers;
  • prevent fraud;
  • maintain security;
  • provide support;
  • maintain business records; and
  • comply with legal obligations.

49. CUSTOMER DATA

Customers remain responsible for the legality and accuracy of data they upload or process using Web Boomers services.

Customers must not use our infrastructure to store or distribute unlawful or unauthorized information.

Where technically and legally possible, Web Boomers may assist with reasonable data export or migration requests.

50. INTELLECTUAL PROPERTY OF WEB BOOMERS

The Web Boomers name, branding, website content, logos, original designs, documentation, and other Web Boomers-owned materials may be protected by intellectual-property laws.

Customers may not copy, reproduce, resell, redistribute, scrape, or commercially exploit Web Boomers-owned materials without authorization, except where permitted by law.

51. PORTFOLIO RIGHTS

Unless otherwise agreed in writing, Web Boomers may display completed client work in:

  • portfolio pages;
  • website;
  • social media;
  • presentations;
  • case studies;
  • marketing materials; and
  • promotional material.

Web Boomers will not intentionally publish confidential passwords, private credentials, or sensitive confidential information as portfolio material.

52. CONFIDENTIALITY

Each party should take reasonable measures to protect confidential information received from the other party.

Confidential information may be disclosed where:

  • required by law;
  • required by a competent authority;
  • necessary to provide the service;
  • necessary to protect security;
  • required to resolve a dispute; or
  • otherwise legally permitted.

53. WARRANTIES AND DISCLAIMERS

Services are provided according to the applicable scope and specifications.

Except where expressly stated in writing, Web Boomers does not guarantee that:

  • every service will always be uninterrupted;
  • every website will be completely error-free;
  • every third-party service will remain available;
  • a website will achieve a particular commercial result;
  • SEO will produce a specific ranking;
  • advertising will generate a specific number of customers;
  • hosting will never experience downtime; or
  • backups will prevent every possible form of data loss.

Nothing in these Terms excludes a right or liability that cannot legally be excluded.

54. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Web Boomers shall not be liable for indirect, incidental, special, consequential, exemplary, or business losses, including:

  • loss of profits;
  • loss of revenue;
  • loss of business;
  • loss of goodwill;
  • loss of opportunities;
  • loss of anticipated savings; or
  • indirect data loss.

Where liability cannot legally be excluded, Web Boomers' liability shall, to the extent permitted by law, be limited to the amount paid for the specific service giving rise to the claim.

This limitation does not apply where prohibited by applicable law.

55. CUSTOMER INDEMNIFICATION

To the extent permitted by applicable law, the Customer agrees to be responsible for claims arising from:

  • unlawful Customer Content;
  • infringement caused by Customer-supplied materials;
  • misuse of Web Boomers services;
  • violation of applicable law;
  • unauthorized access caused by Customer negligence; or
  • violation of these Terms.

This clause does not apply to the extent that the claim was caused by Web Boomers' own unlawful conduct or liability that cannot legally be transferred.

56. THIRD-PARTY SOFTWARE AND LICENCES

Web Boomers may use:

  • open-source software;
  • commercial software;
  • plugins;
  • themes;
  • frameworks;
  • APIs;
  • libraries;
  • fonts;
  • stock assets; and
  • other third-party materials.

Such materials may have separate licence requirements.

Customers must comply with applicable licence terms.

57. OPEN-SOURCE SOFTWARE

Where open-source software is used, the relevant open-source licence continues to apply.

Nothing in these Terms overrides an applicable open-source licence.

58. COPYRIGHT COMPLAINTS

If you believe content hosted or published through a Web Boomers service infringes your copyright, you should contact Web Boomers with sufficient information to identify:

  • the copyrighted work;
  • the allegedly infringing material;
  • its location;
  • your ownership or authorization;
  • your contact information; and
  • the basis of your complaint.

Web Boomers may review credible complaints and take appropriate action where required.

59. LEGAL COMPLIANCE

Customers must comply with all laws applicable to their activities.

Depending on the nature of the service, this may include laws concerning:

  • consumer protection;
  • electronic commerce;
  • information technology;
  • privacy and personal data;
  • intellectual property;
  • taxation;
  • advertising;
  • communications;
  • cybersecurity;
  • fraud prevention; and
  • other applicable regulations.

The Customer is responsible for obtaining professional legal advice regarding laws specific to its business or industry.

60. GOVERNMENT AND LAW-ENFORCEMENT REQUESTS

Web Boomers may disclose information where reasonably necessary to:

  • comply with applicable law;
  • respond to lawful government requests;
  • comply with court orders;
  • investigate suspected unlawful activity;
  • protect customers;
  • protect infrastructure; or
  • protect the rights and safety of Web Boomers or others.

Where legally permitted, Web Boomers may notify affected Customers of such requests.

61. CHANGES TO SERVICES

Web Boomers may modify, improve, replace, discontinue, or introduce services and features.

Where a material change affects an active service, Web Boomers may provide reasonable notice where appropriate.

Third-party features may change without notice because they are controlled by external providers.

62. CHANGES TO THESE TERMS

Web Boomers may update these Terms periodically.

The latest version will be published on the Web Boomers website or client portal.

The updated Terms will identify the applicable effective date.

Continued use of the services after the effective date of an update constitutes acceptance of the updated Terms to the extent permitted by applicable law.

63. ELECTRONIC COMMUNICATION

Customers consent to receiving electronic communications relating to:

  • invoices;
  • payments;
  • account activity;
  • service activation;
  • service suspension;
  • renewal;
  • security;
  • support;
  • policy updates;
  • service notices; and
  • other necessary service communications.

Electronic records and communications may be used as evidence of transactions and communications, subject to applicable law.

64. NOTICES

Official notices may be provided through:

  • email;
  • client portal;
  • website;
  • account notifications;
  • invoice notifications; or
  • other reasonable electronic methods.

Customers are responsible for maintaining a valid email address.

65. ASSIGNMENT

The Customer may not transfer its contractual rights or obligations to another party without Web Boomers' prior written consent, except where permitted by applicable law.

Web Boomers may transfer or assign its rights and obligations where reasonably necessary for business restructuring, service transfer, merger, acquisition, or operational purposes, subject to applicable law.

66. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

67. NO WAIVER

Failure by Web Boomers to enforce a provision of these Terms does not constitute a permanent waiver of that provision.

A waiver must be expressly communicated where required.

68. ENTIRE AGREEMENT

These Terms, together with the applicable quotation, order, invoice, service plan, and referenced policies, constitute the agreement governing the applicable service.

Where a specific written service agreement expressly modifies these Terms, the specific agreement will control to the extent of the conflict.

69. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of India.

Nothing in these Terms is intended to remove mandatory rights available to consumers or other persons under applicable law.

70. JURISDICTION

Subject to applicable mandatory legal rights and statutory dispute-resolution mechanisms, disputes arising from these Terms or Web Boomers services shall be subject to the jurisdiction of the competent courts having jurisdiction in Hooghly, West Bengal, India.

71. CONSUMER RIGHTS

Nothing in these Terms is intended to exclude or restrict rights that a Customer is legally entitled to exercise under applicable consumer-protection law.

Where applicable, statutory consumer remedies remain available.

72. DISPUTE RESOLUTION

Customers are encouraged to contact Web Boomers first to attempt to resolve disputes informally.

A complaint should include:

  • Customer name;
  • registered email;
  • invoice/order number;
  • description of the issue;
  • relevant dates;
  • supporting documents; and
  • requested resolution.

Web Boomers will review legitimate complaints and attempt to provide an appropriate response.

This informal process does not prevent a Customer from exercising any statutory rights available under applicable law.

74. CUSTOMER ACKNOWLEDGEMENT

By creating an account, placing an order, checking an acceptance box, submitting payment, or using a Web Boomers service, the Customer acknowledges that:

  1. the Customer has read these Terms;
  2. the Customer understands these Terms;
  3. the Customer agrees to comply with these Terms;
  4. the Customer has reviewed the applicable service conditions;
  5. the Customer understands the applicable payment and cancellation conditions; and
  6. the Customer understands that third-party services may be subject to separate terms.
